Swimwear Photo/Video Modeling Release Legal Information:

All of the Swimwear Models that appear or featured on this site, www.modelingdvds.com do so with the full written permission of their parent(s) or legal guardian and have been thoroughly briefed on all aspects of the web site modeling proposal. This release requires both the model and parents signature on the form. By signing, a parent states on this agreement that they are aware of the use of the Swimwear DVD product and understands all aspects of the assignment, including the term Flat Fees. A Flat Fee means the model is paid to do each shoot and is not owed any additional monies from the photographer /business resulting from the sale of the modeled swimwear or DVDs whether one or thousands. Over 18 models will sign a standard release as well, however their form doesn't require a parents signature.

A Note about the model release:

This is a legally binding agreement between our business, a parent and minor and cannot be "voided"  or more officially "disaffirmed " if you just wake up one day and decide to change your mind. This legal document doesn't expire when a model turns 18, just like any other legal debt acquired as a minor. The option always exist however to buy back your modeling release or make provisions for some other mutually acceptable means of compensation or agreement to DBPRO.

We spend a lot of time and money on these Models, the shoots, clothing, the DVD productions and the marketing and other  tasks and costs, to just hand them back and take the loss is not something we are going to do without due consideration.

Florida Code Section 743.08:

"The state of Florida has eliminated the rights of minors to disaffirm certain contracts for 'artistic or creative services'"

Section 743.08(1)(a) defines "artistic or creative services" to include "services as an actor, actress, dancer, musician, vocalist, model, stunt person, conductor, or other performing artist."

Additional modeling sessions are compensated at the time of the shoot, and the existing release document applies as well. Any  monies paid out by the photographer / business as a bonus or retainer or living assistance to the models between scheduled shoots is solely his discretion and NOT obligated to the parents or models. These amounts are documented.
